I, ___________________________________ , breeder/owner of the said puppy (described below), hereafter referred to as "Seller," do enter into an agreement with

____________________________________, hereafter referred to as "Buyer" for the purpose of transferring ownership of said puppy.  The said puppy is a (list color and gender) ________________________________ purebred Cavalier King Charles Spaniel.

The seller will transfer ownership of the said puppy for $______________, to be paid in full, plus shipping costs, before the puppy can be shipped or delivered.  Final payment must be received at least 7 days prior to scheduled pickup/shipping date.  Seller will accept cash, cashier's checks,  money orders, or bank drafts.  No personal checks or credit cards, please.

Buyer has paid a $___________________ puppy deposit to be subtracted from the final purchase price.  The deposit amount must be no less than 1/3 of the total price. The puppy deposit is placed to hold said puppy for Buyer until puppy is of appropriate age and  physical development to be transferred to Buyer. Puppy deposit is non-refundable.   

This puppy is being placed on a spay/neuter agreement.  (An additional agreement is required in writing for full registration privileges.)  The AKC papers may be provided for an additional $65 when Buyer has had the puppy altered and has given written proof to the Seller.  This proof must include the name and contact information of the DVM who performed the surgery.  The Buyer agrees to have the operation performed BEFORE puppy is 9 months of age.  Verification of spay/neuter must be provided to Seller within 1 month of the surgery or this contract is void.  (This applies strictly to puppies sold without breeding rights.)

HEALTH GUARANTEE

1.  The Seller guarantees the said puppy is in good health to the best of Seller's knowledge, based on the veterinary health certificate, at the time of this agreement as well as at the time of shipping/delivery.

2.  The Buyer agrees to have the puppy examined by a reputable veterinarian within 48 HOURS from the time of the purchase.  (Please have a veterinary appointment set prior to bringing your new puppy home.)  If this veterinarian establishes a problem with the puppy upon initial examination, (Internal/external parasites and "kennel cough" excluded.) which will significantly affect the puppy's quality of life, and if Seller is notified within two (2) business days of the veterinarian’s determination, the Seller will replace the puppy with one of equivalent value when the next litter is available.  (See paragraph #12 for return procedures.)  The Seller will not be responsible for veterinarian fees or shipping cost.  Seller reserves the right to require a second opinion from a vet of the Seller's choosing.

The replacement/exchange option is not available if the handicap is due to any kind of accident, including the puppy injuring his/her knees or legs by jumping off furniture or stairs, or in the event abuse of any form, whether or not it was intentional, was instrumental in the puppy's misfortune.  

The puppy is guaranteed not to have a contagious disease for 72 hours after it has left the care of the Seller.  (Internal/external parasites and "kennel cough" excluded.)  If the puppy develops an illness 72 hours or longer after he/she has left the care of the Seller, the Buyer understands the illness was probably contracted after the puppy was left in the care of the airlines or picked up by the Buyer.  Adequate protection against contagious diseases has been provided to the puppy.  However, the Buyer understands that NO form of vaccination is 100% fool proof, especially on a young puppy.

3.  If within one (1) year from the date of acquisition, a puppy is found and certified by a licensed veterinary specialist to have a life threatening hereditary disorder, and if Seller is notified within two (2) business days of the veterinarian’s determination, Seller will replace the puppy with one of equivalent value when the next litter is available.  Complete health records, diagnostic tests, and their results must be provided to Seller in order to qualify for a replacement.  However, the Seller will not be responsible for veterinarian fees or shipping costs.  Seller reserves the right to require a second opinion from a vet of the Seller's choosing

Buyer understands the replacement option is only valid when the life threatening disorder is verifiably attributed to heredity.  Replacement is not an option when health problems are due to parasites, contagious diseases or other illnesses, nor any kind of accident, including the puppy injuring his/her knees or legs by jumping off furniture or stairs.  Because Seller has no control over how the puppy is cared for when in possession of Buyer, Seller cannot be responsible for health problems caused by diet deficiencies, immune system deficiencies, medications, vaccinations, heartworm prevention, misc. wormers, or any external/internal parasite treatments.  Please see our web site for safe alternatives. 

4. In the event of the death of the puppy within three (3) years from its birth due to Syringomyelia (SM) or Mitral Valve Disease (MVD), the seller shall replace the puppy with another of equivalent value when the next litter is available. The buyer must have an autopsy performed by a licensed veterinarian within 24 hours of death to determine the exact cause of death.  A certified copy of the death certificate, as well as all medical records, must be sent to the Seller.  If an illness, nutritional deficiencies, over-vaccination, toxicity, trauma, or neglect is found to play a role in the demise of the puppy in any manner or fashion, no exchange will be forthcoming.  Additionally, Buyer agrees to hold Seller harmless for such.

GENERAL INFORMATION

5.  If you live in an apartment complex, or any other residence that may restrict pets, you are affirming that you have received permission from the proper authority for this puppy.

6.  No guarantee is made as to disposition, conformation, or breeding ability of the puppy.

7.  It is impossible to accurately determine the exact adult size of any puppy sold, therefore, we cannot give any size guarantee.  Size estimate is based on bloodline, age, and size of puppy at the time of sale.

8.  Just as in the case of having a human baby, the Seller cannot guarantee that any pet you buy will be problem free throughout it's lifetime.  Reasonable precautions have been taken to prevent this puppy from acquiring hereditary problems.  However, because environmental causes of health problems are possible, because Seller no longer has control of the puppy's care, and because we are dealing with living animals, you, as the Buyer, realize and understand that Seller will not be responsible for conditions other than those listed.

9.  The Buyer certifies by signing this contract that the puppy will live in the house with the Buyer, be confined by a fenced yard or receive adequate supervision when outside, will have adequate exercise, nutritious food, constant access to fresh water, be maintained at a healthy weight, and receive all necessary health care.  This healthcare will include using nosode vaccines in lieu of allopathic vaccines, OR implementing the vaccination schedule developed by Dr. Jean Dodds, which is endorsed by the original Cavalier King Charles Spaniel Club - CKCS. http://www.ckcsc.org/ckcsc/ckcsc_inc.nsf/founded-1954/vaccination.html  Buyer will NOT allow annual booster vaccinations to be administered since it has been determined by AAHA that vaccinations are effective for a minimum of three years. (Seller can provide information regarding safe alternatives.)   The Buyer also certifies the puppy will not be left alone for long periods of time on a regular basis.

10.  The Buyer agrees that if it becomes necessary to sell or otherwise dispose of this pet, the Buyer will notify the seller before taking such action so that the pet may, at the Sellers’ option, be re-purchased by the Seller for half of the original purchase price.  Upon notification, the Seller shall have 15 working days to exercise said re-purchase option.  Even if Seller cannot repurchase the dog, Seller will accept the dog back at any time for any reason. 

11.  The Buyer certifies, by signing this contract, that he/she is not acting as an agent in this purchase, and that the buyer will not resell this puppy to a pet store or medical research facility.  The Buyer further agrees the puppy will NEVER be placed in an animal shelter of any kind.

RETURNS

12.  Seller will consider a replacement puppy only if the puppy is seen by a DVM in the required time frame. If the puppy has not visited the Veterinarian, as agreed, within the 48-hour time frame, NO exchange will be considered.  Second opinion from a vet of Seller's choosing is required for an exchange.

   A. To return a puppy, notify us by phone prior to return.  All original veterinarians' reports and registration papers (if they were received at the time of purchase) must be presented with the puppy .

   B. If Seller's vet agrees a replacement is warranted, Buyer will be given a replacement puppy of comparable size and value.  If replacement puppy is not available at this time, Buyer will be given a voucher for a puppy and notified IMMEDIATELY when a comparable puppy is available.  All exchanges are limited to a puppy of the same value as the original puppy.  Buyer has the option of keeping the defective puppy or returning the puppy to Seller.

   C. If the puppy dies within the 72-hour guarantee period, Buyer will take the deceased puppy to a veterinarian of his or her choice for the purpose of an autopsy at Buyer's expense. The deceased puppy must be returned with all previous medical records, a statement from the veterinarian regarding the cause of death and a certified copy of the death certificate.  If the puppy died of natural causes of a warrantable condition, a replacement puppy will be provided to Buyer. However, if vaccinations, medications, toxicity, trauma or neglect is found to play a role in the demise of the puppy in any manner or fashion, no exchange will be forthcoming.  Additionally, Buyer agrees to hold Seller harmless for such.

13.  This agreement is made and entered into in the State of Texas, Guadalupe County, and shall be enforced and interpreted under the laws of this State and County.

14.  This contract is made and signed by both the Seller and the Buyer for the well being of the pet.  Buyer certifies that no part of this contract will be breached.  If this contract is breached by Buyer, the contract is void, and Seller may repossess the puppy/dog at no expense to Seller.

What our contract means, in laymen's' terms:

We are selling you a purebred, purely spoiled, purely loved Cavalier King Charles Spaniel puppy or dog.  We have done everything we can to ensure your Cavalier is healthy, including the following:

  • All puppies are bred, born, and raised in our home.

  • All Cavaliers are given highly nutritious, all natural food in ample amounts, along with food based, all natural supplements.  We ask that you also provide optimum nutrition for your Cavalier.

  • We take our Cavaliers to professionals for appropriate health testing.

  • We follow the vaccination protocol recommended by the oldest Cavalier club in existence, the CKCSC.  We ask that you do likewise.

  • We guarantee your puppy will not have a life threatening genetic health problem during it's first year of life.

  • We guarantee your Cavalier will not succumb to MVD or SM during it's first three years of life.

  • Health issues that are not covered are due to the fact that we have no control over the Cavalier once it leaves our care.

You need to take your new Cavalier to your vet shortly after bringing him or her home to verify that you have a health pet.

  • In the unlikely even that your Cavalier becomes ill from a genetic disease or defect in the first year of life, you need to let us know as soon as you can.  You then need to send us all medical records and health testing information.  If our vet agrees with your vet's findings, we will give you another Cavalier of equal value.  You may keep your original Cavalier, or you may give it back to us to care for.

  • If your Cavalier succumbs to MVD or SM anytime before his or her third birthday we will give you another Cavalier of equal value.
We have been breeding since 2000.  In this time, we have produced the following number of genetic problems:

MVD - Mitral Valve Disease or congestive heart failure of any kind:  Zero

SM - Syringomyelia, AKC Chiari malformation:  Zero

Corneal problems, or any significant genetic disorders of the eyes:  Zero

Deafness:  The one and only albino Cavalier we produced a few years back is suspected of having less than perfect hearing.  Other than this, the number is zero.

Episodic Falling Syndrome:  Zero

Epilepsy:  One puppy, and only one puppy, from one of very first litters, years ago, had seizures after a series of vaccinations were given at one appointment.  We sincerely and humbly believe this was NOT genetic.  Other than this, zero.

Diabetes mellitus:  Zero

Hypothyroidism:  Zero

It is our continued prayer that our Cavaliers will remain blessed with good health.  We will be certain to do whatever it takes to keep our lines free of the above mentioned genetic health defects, as well as those we may have missed mentioning.
